Terms of Service

1. About This Store

This is an independent, individually operated store. All photographs offered for sale are original works created and printed by me. Orders are processed, packed, and shipped from a home-based studio, not a commercial warehouse — please allow for that in shipping expectations, especially around travel or high-volume periods.

2. Products

All prints are made to order unless otherwise noted on the product page. Because prints are produced individually, minor variations in color and finish between what’s shown on screen and the final print may occur — monitors render color differently, and this isn’t a defect.

3. Ordering and Payment

Orders are accepted subject to availability and confirmation of payment. Payment is processed securely through [SureCart/Stripe — name your processor]; I do not store your card details. I reserve the right to cancel or refuse any order at my discretion, including for suspected fraud, pricing errors, or inability to fulfill.

4. Pricing

Prices are listed in USD and are subject to change without notice. Prices at the time of order confirmation are what you’ll be charged. Shipping costs are calculated separately at checkout.

5. Shipping

Prints ship from Rhode Island via USPS. Processing time is typically 5 business days before shipment, given each print is prepared individually. I am not responsible for delays once a package is in the carrier’s hands, though I will assist with any lost-package claims where possible.

6. Returns and Damaged Items

Because prints are made to order, I do not accept returns for buyer’s remorse. However:

• If your print arrives damaged in transit, contact me within 7 days of delivery with photos of the damage and packaging, and I will arrange a replacement or refund.
• If there is a genuine error on my part (wrong item, printing defect), I will correct it at no cost to you.

7. Copyright and Usage Rights

All images are © Mark Levine and protected under copyright law. Purchasing a print grants you ownership of that physical print only — it does not transfer any rights to reproduce, scan, publish, or otherwise use the image. Commercial licensing or reproduction requests should be directed to me directly.

8. Limitation of Liability

To the extent permitted by law, I am not liable for indirect, incidental, or consequential damages arising from your use of this Site or purchase of products, beyond the value of the order itself.

9. Privacy

Information collected through this Site is handled according to my Privacy Policy.

10. Governing Law

These terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law principles.

11. Changes to These Terms

I may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
